Online Identifiers Requirements
On December 31, 2007 a change to sex offender laws went into effect regarding online identifiers, websites, and internet communication. It is important that you understand this change to the law as it will be a felony if you do not comply with the new requirements. Read the following law and certify that you understand the requirements. You can submit the form electronically using the Online Identifiers Certification Form.

Any person required to register shall register with the sheriff their required online identifier and the name of any website or internet communication service where the identifier is being used or is intended to be used. Registration is required regardless of whether the person was required to register an identifier at the time of their initial registration.

On the person’s initial registration and every year after the person’s initial registration, the person shall confirm any required online identifier and the name of any website or internet communication service where the online identifier is being used.

Any person required to register shall notify the sheriff either in person or electronically within seventy-two hours, excluding weekends and legal holidays, after a person makes any change to any required online identifier, and before any use of a changed or new required online identifier to communicate on the internet.

Definitions

Required online identifier:
Any electronic email address information or instant message, chat, social networking or other similar internet communication name, but does not include social security number, date of birth or pin number.

Social network service: (As defined by Wikipedia). “A social network service focuses on the building and verifying of online social networks for communities of people who share interests and activities, or who are interested in exploring the interests and activities of others, and which necessitates the use of software. Most social network services are primarily web based and provide a collection of various ways for users to interact, such as chat, messaging, email, video, voice chat, file sharing, blogging, discussion groups, and so on."

What does the law mean?

You must notify the Sheriff’s Office of:

  • Any email address you use, including any work related email addresses you use. If you use an email address that belongs to someone else, you must notify the Sheriff’s Office of this email address.
  • Any instant message identifier (name) you use in any instant message conversation and the instant message service that is being used.
    Any chat identifier (name) you use in any chat room, the name of the chat room and the service provider of the chat room, such as AOL, Yahoo, etc.
    Any file sharing service along with your identifier (name) for the file sharing service. Examples of this would be Kazaa, BitTorrent, etc.
  • Any other social networking identifier (name) you use along with the name of the social networking site. Examples of this would be MySpace, dating service sites, blogging sites, discussion groups, etc.
If you are using a computer to communicate with others or engaging in file sharing, you are using social networking and you must notify the Sheriff’s Office of any identifier you use.

Each year you must re-contact the Sheriff’s Office to confirm your online identifiers. Failure to comply is a class 6 felony.
